Federal Court Mandates Release of Abrego Garcia from ICE Custody
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks legal authority.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her ruling.
The case stems from a mistaken removal to El Salvador in March, which the government later admitted was an error. After his repatriation to the United States to face human smuggling allegations, he was detained in federal custody.
In her order, the court noted that the government does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
